El origen del título valor, así como su circulación, es consecuencia de un negocio jurídico que sirve de causa; ya sea a título oneroso o gratuito. Por eso en muchas de las normas, que regulan el tema cartular, se hace referencia al negocio jurídico, fundamental u originario. Podemos citar como ejemplo, el artículo 620 el cual refiere a las menciones y requisitos que el título deba contener y si faltaren “no afecta el negocio jurídico que dio origen al documento o al acto.” El artículo 882, faculta al tenedor hacer “efectivo el pago de la obligación originaria o fundamental”. El precepto 784, permite al deudor formular excepciones relacionadas “con el negocio jurídico que dio origen a la creación o transferencia del título.” (Num. 12).
