Derecho positivo
Ley es la norma jurídica emanada de los órganos competentes del Estado y destinada a regular las relaciones sociales de una comunidad, conocido como derecho positivo.
El derecho positivo es el conjunto de normas de derecho que regulan la vida y las relaciones sociales de una comunidad. Viene a constituir un ordenamiento jurídico por virtud del cual se legitiman los poderes bajo la figura constitucional del debido proceso. Razón por la cual constituye el fundamento del derecho material o sustancial, con el cual válidamente se resuelven los conflictos económicos y personales que surgen en la sociedad.
Se distingue las reglas de orden particular y las de orden publico. Las primeras se ocupan de las relaciones particulares y las primeras de la dogmática, la organización y las relaciones entre las instituciones y éstas con los particulares. La codificación de las normas que lo integran estructura el derecho objetivo y derecho subjetivo.
El derecho objetivo
Conjunto de normas que se ocupan de la regulación de la conducta de las personas. Establece las reglas de observación en la ejecución de relaciones sociales. Determina quien puede celebrar un negocio jurídico, cómo se adquiere el dominio de las cosas y traza la línea de comportamiento en el ejercicio de derechos y de defensa de los mismos. Por tanto, constituye un sistema normativo que consagra derechos y obligaciones in abstracto, para todos los asociados.
Hace parte del derecho objetivo la compilación normativa erigida en los códigos, las leyes y los decretos y, por supuesto, en la Constitución.
El derecho subjetivo
Son facultades de que gozan los titulares de derechos para ejercer y velar por su reconocimiento frente a los demás asociados. Es la potestad jurídica en virtud de la cual se otorga poder de disposición para que la persona desarrolle, legalmente, un determinado comportamiento. De acuerdo con las directrices que surgen del derecho objetivo.
Hace parte del mismo derecho objetivo pero no como un derecho abstracto sino concreto, para reclamar un derecho o pedir su recomposición. Así por ejemplo, el matrimonio es un derecho objetivo regulado por el código civil al cual puede acudir todos los asociados. Si una pareja contrae matrimonio adquiere derechos y obligaciones, y, a su vez, facultades para la defensa de aquellos.
Derecho de acción
La iniciativa de las facultades es un derecho fundamental del libre desarrollo de la personalidad del titular (C. Por. art. 16). Cuyo ejercicio es producto del derecho de acción que nace del derecho subjetivo y se ejercita a través de las reglas de procedimiento. La acción se concretiza en la pretensión invocada en la demanda que debe tramitarse por el proceso respectivo (CGP art. 82, 88, 368).
