El derecho romano no distinguió completamente la pena de la reparación o indemnización. Se confundía la responsabilidad civil con aquella de orden penal. Razón por la cual se crearon algunas acciones con fines principalmente indemnizatorias, denominadas acciones re persecutorias, y las de orden penal. Entendidas como una mixtura entre la sanción punitiva y la reparación.
Esa es la razón por la que el derecho romano no hizo una distinción entre responsabilidad contractual y extracontractual. Los diferentes “delitos” para los cuales la ley o el pretor concedían acciones a la víctima, tenía como fuente la violación de un contrato o de una regla extracontractual.
La responsabilidad contractual y extracontractual
Los ordenamientos objetivos se ocupación de zanjar y generar una brecha normativa para las dos clases de responsabilidades. Permitiendo, que algunas instituciones se suplan de una misma fuente. Así, por ejemplo, en materia contractual se previó que uno de los efectos de las obligaciones es la responsabilidad del deudor; estableciéndose de en el artículo 1604 del Código Civil Colombiano, las reglas de reparación y exoneración[1].
A partir del artículo 2341 del Código Civil, se erigió la institución de la responsabilidad extracontractual originada en el delito o la culpa. Si perjuicio de la pena principal que la ley especial imponga por el punible en que se incurra.
Legitimación para pedir la indemnización
En la responsabilidad civil contractual se legitima para pedir la indemnización el contratante cumplido. De acuerdo con la regla general de los preceptos 1546[2], 1609[3] entre otras normas del Código Civil.
En la responsabilidad de orden extracontractual puede pedir la indemnización el dueño o poseedor de la cosa sobre la cual ha recaído el daño o su heredero. El usufructuario, el habitador, o el usuario, si el daño irroga perjuicio a su derecho de usufructo, habitación o uso. Puede también pedirla, en otros casos, el que tiene la cosa, con obligación de responder de ella; pero sólo en ausencia del dueño (C.c. art. 2342)
Obligados a indemnizar
En la responsabilidad contractual la obligación de indemnizar tiene lugar a partir de la mora del deudor. Así se desprende del artículo 1608 del Código Civil, al erigir las reglas tales como:
- Cuando no ha cumplido la obligación dentro del término estipulado; salvo que la ley, en casos especiales, exija que se requiera al deudor para constituirlo en mora.
- Cuando la cosa no ha podido ser dada o ejecutada sino dentro de cierto tiempo y el deudor lo ha dejado pasar sin darla o ejecutarla.
- En los demás casos, cuando el deudor ha sido judicialmente reconvenido por el acreedor.
Cuando se trata de responsabilidad extracontractual, debe reparar el daño quien ejecutó el daño y sus herederos. También el que recibe provecho del dolo ajeno hasta concurrencia de lo que valga el provecho que hubiere reportado (C.C. art. 2343).
Existen otros responsables indirectos como el guardián de la cosa, el guardador o representante de menores (C.C. art. 2346 y 2347).
Responsabilidad solidaria
Se presenta cuando el delito o culpa ha sido cometido por dos o más personas. En tal evento cada una de ellas será solidariamente responsable de todo perjuicio. “Todo fraude o dolo cometido por dos o más personas produce la acción solidaria del precedente inciso” (C.C. art. 2344).
No hay solidaridad en la responsabilidad por los daños causados por un edificio en ruinas. “Si el edificio perteneciere a dos o más personas proindiviso, se dividirá entre ellas la indemnización, a prorrata de sus cuotas de dominio” (C.C. art. 2350 Inc. 3º).
Tampoco tiene lugar la responsabilidad in solidum, de las cosas que caen del edificio y el hecho es imputable a varias personas. En este evento la indemnización se dividirá entre todas ellas. Incluso desaparece la división si “… se pruebe que el hecho se debe a la culpa o mala intención de alguna persona exclusivamente, en cuyo caso será responsable ésta sola.” (C.c. art. 2355).
El deudor no es responsable sino de la culpa lata en los contratos que por su naturaleza solo son útiles al acreedor; es responsable de la leve en los contratos que se hacen para beneficio recíproco de las partes; y de la levísima en los contratos en que el deudor es el único que reporta beneficio.
El deudor no es responsable del caso fortuito, a menos que se haya constituido en mora (siendo el caso fortuito de aquellos que no hubieran dañado a la cosa debida, si hubiese sido entregado al acreedor), o que el caso fortuito haya sobrevenido por su culpa.
La prueba de la diligencia o cuidado incumbe al que ha debido emplearlo; la prueba del caso fortuito al que lo alega.
Todo lo cual, sin embargo, se entiende sin perjuicio de las disposiciones especiales de las leyes, y de las estipulaciones expresas de las partes.
[2] En los contratos bilaterales va envuelta la condición resolutoria en caso de no cumplirse por uno de los contratantes lo pactado. Pero en tal caso podrá el otro contratante pedir a su arbitrio, o la resolución o el cumplimiento del contrato con indemnización de perjuicios.
[3] En los contratos bilaterales ninguno de los contratantes está en mora dejando de cumplir lo pactado, mientras el otro no lo cumpla por su parte, o no se allana a cumplirlo en la forma y tiempo debidos.
