El reconocimiento de derechos

na de las reglas generales del derecho adjetivo ha sido la necesidad de que las partes fijen los derroteros sobre los cuales el juez debe adoptar una determinada decisión. Como una consecuencia propia del derecho dispositivo que, de alguna manera, limita la oficiosidad. Es patente que las decisiones deben adoptarse de acuerdo con los pedimentos de las partes. Esa es la postura del principio de acceso a la justicia previsto en el artículo 2o del Código General del Proceso[1].
El ámbito de toda controversia judicial, por razón del principio dispositivo citado, corresponde exclusivamente a las partes del litigio. Bajo ese norte, es claro que las peticiones de las partes rodeadas de los supuestos fácticos con los cuales se motivan, fija la competencia del operador judicial para resolver, conforme lo acreditado en la instancia, los problemas jurídicos puesto a consideración. Delimitados, por supuesto, a las razones que son, efectivamente, el motivo de inconformidad.
El debate jurídico se centra en lo pedido por las partes
En ese orden el debate se centra a los problemas jurídicos que las partes hayan puesto a consideración. El actor lo hace con sus pretensiones[2] fundadas en los hechos[3] que le sirven de soporte y, el extremo pasivo, en los medios exceptivos[4] de fondo con los cuales invoca el aniquilamiento de aquellas. Sin dichas proposiciones de parte no es posible el desenvolvimiento de los derechos subjetivos. El objeto de la pretensión y de la excepción, como se sabe, es procurar una decisión judicial favorable a los intereses de las partes.
Así lo sostuvo la jurisprudencia[5] al señalar que en desarrollo del principio dispositivo que en múltiples aspectos informa el procedimiento civil, es indudable que corresponde exclusivamente a las partes la función de fijar o delimitar el ámbito de la controversia.
Tal facultad, dijo:
“… deviene de la naturaleza de la intervención del Estado en los asuntos de los particulares, pues los jueces reciben la potestad jurisdiccional. En los estrictos marcos señalados por la ley. Pero también dentro de los linderos que trazan las partes en las oportunidades que los procedimientos brindan …”.
En el proceso civil, sostuvo, el juez no puede irrumpir en la esfera de inmunidades y derechos que el sistema jurídico reconoce a los individuos al amparo del principio de autonomía privada. Por lo que, de modo general, es a la víctima de la lesión de un derecho, a quien corresponde dar fisonomía a su protesta y no puede ser sustituido en esa tarea por el juez. “Tal es la valía del principio dispositivo que prevalece en el proceso civil, pues expresa que el poder del juez tiene límites y que por lo mismo le está vedado reemplazar al ciudadano en la configuración del reclamo que somete a la consideración (…).”
La decisión judicial debe consultar lo pedido
Por esas razones, se hace, aún más insostenible, justificar reconocimientos y condenas por encima del pedido por el actor y lo invocado como defensa por el extremo pasivo. La sentencia, establece el artículo 281 del Código General del Proceso, debe consultar el principio de congruencia. El cual impone la consonancia con los hechos y las pretensiones aducidos en la demanda y con las excepciones que aparezcan probadas y hubieren sido alegadas si así lo exige la ley (inc. 1º). Impidiéndose condenas por cantidades superiores o por debajo de lo pedido en la demanda y por causas diferentes a la invocada (Inc. 2º). Además, si lo pedido por el demandante excede de lo probado se le reconocerá solamente lo último (Inc. 3º).
La jurisprudencia de la Corte Constitucional[6] sobre el principio de consonancia, ha referido que:
“En términos sencillos, puede afirmarse que el principio de consonancia establece que la competencia funcional del juez se restringe al pedido de las partes; es decir, a las súplicas de la demanda y a las excepciones propuestas por la contraparte”.
Lo que para Devis Hernando se conoce como un “principio normativo que delimita el contenido de las resoluciones judiciales que deben proferirse, de acuerdo con el sentido y alcance de las peticiones formuladas por las partes …”[7]
Reconocimiento oficioso de excepciones
No obstante, el veto a reconocer derechos no reclamados por las partes no es absoluto. El ordenamiento adjetivo colombiano han contemplado la posibilidad del reconocimiento de excepciones de oficio. Con la condición de que se funde en hechos debidamente probados y discutidos dentro del proceso. Esta facultad está prevista en el precepto 281, cuando autoriza, sin contravenir la congruencia del fallo, que la sentencia debe ser consonante con los hechos y las pretensiones aducidos en la demanda y con las excepciones que aparezcan probadas y hubieren sido alegadas si así lo exige la ley (inc. 1º).
Con mayor categorización el reconocimiento de excepciones de oficio deviene del artículo 282 del Código General del Proceso. Esta norma procesal establece que en cualquier clase de proceso cuando se halle probado un hecho que constituya una excepción deberá
